CNN has learned that authorities in New York City are investigating a rape allegation against actor Devin Ratray, best known for his role as the big brother in the “Home Alone” films.

Devin Ratray was born in New York City, New York, USA on January 11, 1977. He is an actor and writer, best known for his roles in Nebraska (2013), R.I.P.D. (2013), and Masterminds (2013). (2016).
Where did Smith and Devin go?
Smith told CNN that she had known the actor for about 15 years before the alleged assault on September 21, 2017. She said she met her brother, another friend, and Ratray at a bar in New York City that night. After that, the group went to Ratray’s Manhattan apartment for another drink.
The Explanation of that night
Devin seemed determined to give her a specific glass. Smith stated that she became exhausted shortly after drinking the beverage, and Ratray encouraged her to stay and sleep on his couch. She claims to have been drugged.
“I remember waking up unable to move. I couldn’t really open my eyes, but I could hear and feel what was going on around me. I knew the other two people had left, but I was still sitting on the couch “Smith stated. Ratray allegedly sexually assaulted her for what felt like a “eternity.”
She did Police Complain
It was around 2 p.m. the next day that Smith was able to move enough to put on her clothes and leave the apartment, she said.
Smith stated that she was initially hesitant to report the alleged rape because she had previously been assaulted by another man and felt she was treated unfairly by police after filing a complaint and submitting to a rape kit examination. An NYPD source confirmed to CNN that Smith had previously made a report.
A day after the Alleged Assault
A day after the alleged assault, Smith confronted Ratray via text message. Ratray, she said, denied the text-based assault. Smith no longer has the texts. But a transcription of the alleged messages was found in a separate text. That is exchange between Smith and her sister, a copy of which CNN examined.

Ratray attempted to portray the incident as a consensual encounter, according to Smith’s interpretation of his response. But claimed he couldn’t have sex because he was “impotent.”
The Police get involved
In the fall of 2018, nearly a full year after Smith first reported her assault to the NYPD. She said she came across a storage bin with the outfit. She was wearing the night of the alleged assault. Specifically the sweater she had been wearing that she believed may have had DNA evidence on it. She told the NYPD detective about her discovery and mailed it to him. She did not hear from the detective after she sent him the clothing.
Smith Met with Prosecutor
Smith claims she met with a prosecutor from the Manhattan District Attorney’s Office’s Sex Crimes Unit in May, who she claims apologised for the way her case was handled.
Smith told the prosecutor that she “should have at least been offered victims counselling all those years ago.” “When she said that, I started crying because I realised it was the first time anyone had acknowledged how deeply impacted I had been or that I had been traumatised.”
